Terms of Use & Service Agreement

All code modifications, surgical bug repairs, and custom engineering services delivered by JSP The Tech Life are delivered exclusively in isolated, separate branches of Git (e.g. GitHub branches) or isolated project ZIP archives and are 100% reversible. The client maintains sole and exclusive authority to inspect, test, merge, deploy, or revert any code deliverable into production environments.
1. Agreement & Acceptance of Terms
By accessing or using jspthetechlife.com, creating a user account, purchasing a code review session, booking an engineering sprint, or uploading a source code archive to our studio systems, you agree to be bound by these Terms of Use and our Privacy Policy. This agreement is between you (or the business entity you represent) and JSP The Tech Life ("Studio", "we", "us", operated by Daryl Marcano / JSP Productions).
2. Scope of Advisory & Engineering Services
JSP The Tech Life provides technical advisory consultations, code quality audits, plain-English diagnostic reporting, developer workstation configurations, and custom engineering sprints. You acknowledge that:
- Advisory Nature: Diagnostic reports and consultations reflect expert technical opinions based on the state of your codebase at the time of inspection.
- Reversible Delivery: All code changes are pushed to an isolated branch in your repository or delivered in a separate clean archive. You retain final discretion whether to merge, build, or deploy.
- Pre-existing Debt: We are not responsible for existing defects, architectural flaws, third-party library obsolescence, or unstated requirements present in your code prior to engagement.
3. Limitation of Liability & Developer Protection
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JSP THE TECH LIFE, ITS FOUNDER AND LEAD DEVELOPER (DARYL MARCANO), ASSOCIATES, CONTRACTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR:
- Any indirect, incidental, consequential, special, exemplary, or punitive damages;
- Loss of revenue, sales, business opportunities, profits, data, goodwill, or commercial reputation;
- Production server downtime, cloud billing overages, database corruption, or runtime errors arising from the client’s deployment or merge of code changes;
- Delays, rejections, or enforcement actions by third-party platforms, including but not limited to the Apple App Store, Google Play Store, Cloudflare, Supabase, Stripe, or payment processors.
CAP ON MONETARY LIABILITY: Under no circumstance shall the aggregate total liability of JSP The Tech Life and its developers exceeding the exact fee actually paid by you to JSP The Tech Life for the specific service session or audit pass in dispute ($125 for a Codebase Diagnostic session).
4. Acceptable Use & Strict File Upload Policy
To protect our studio infrastructure, developer workstations, and community members, users must adhere strictly to the following upload and conduct guidelines:
- Strictly Source Code ZIP Archives: The code audit upload portal permits only genuine software source code archives ending in
.zip. Profile avatars must be standard image files (.png, .jpg, .jpeg, .webp). - Prohibited Files: Uploading executable files (
.exe, .bat, .cmd, .sh, .com, .bin), malware, viruses, trojans, ransomware, illegal content, or proprietary source code that you do not own or hold valid license to is strictly forbidden. - Security Scans: All uploaded archives are subject to automated hash checks and anti-malware verification before unpackaging.
5. Community Conduct, Reviews & Policy Enforcement
Our studio values professionalism, candid technical feedback, and respectful collaboration.
- Review Integrity: Reviews submitted through your account must reflect authentic, firsthand client experiences. Submissions undergo administrative review before publication on the live website.
- Zero Tolerance for Hostility: Any user who engages in threatening, abusive, defamatory, harassing, profane, or malicious behavior—whether in public reviews, support tickets, or direct communications—will be subject to immediate and permanent account suspension.
- Admin Authority: Studio administrators reserve the absolute right to ban or unban accounts, remove inappropriate content, refuse service, and report unlawful activity to competent authorities without prior notice.
6. Expanding Beta Testing Network & Community Participation
JSP The Tech Life operates an expanding, community-driven testing network designed to facilitate compliance with store testing mandates, including Google Play's 20-tester closed track requirement and Apple TestFlight user feedback audits. By participating in or nominating testers to our testing pool, you agree to the following terms:
- Voluntary Participation & Zero Obligation: Participation in the testing pool—whether as an app owner, direct applicant, or friend/family nominee—is 100% voluntary. Testers are under absolutely no obligation to download, install, run, or review any other application in the pool. Testers are free to test only the specific build for which they were invited or opt into additional tracks solely at their discretion.
- Friends & Family Nominations & Mandatory Double Opt-in: Registered users and clients may invite colleagues, friends, or family members to join the testing pool to help test their software. Any nomination submitted through our platform triggers an automated verification request. The nominee is never enrolled as an active tester until they explicitly click the verification link and confirm their opt-in. Unconfirmed nominations can be retracted or declined at any time.
- Immediate Unsubscribe & Self-Service Data Erasure: Any tester or nominee may unsubscribe from testing communications and completely erase their personal information, email address, and device logs from our database at any time using our self-service deletion tool at /beta-testing#opt-out or by clicking the opt-out link in any testing email. Deletion takes effect immediately with zero penalty.
- Pre-Release Software Disclaimers: Testing involves early-stage, pre-release alpha and beta builds. Testers acknowledge that pre-release software may contain bugs, crashes, or unoptimized features. Testing is conducted at the tester's sole discretion on their personal physical hardware, and JSP The Tech Life shall not be liable for platform instabilities or data loss on user devices resulting from third-party test builds.
7. Intellectual Property & Code Confidentiality
Your Code Remains Yours: You retain complete, unencumbered ownership of all intellectual property, source code, and assets you provide to JSP The Tech Life. We hold all client repositories, archives, and project details in strict professional confidence. We never sell, license, publish, or train external machine-learning models on client code.
8. Payment, Booking & Refund Terms
All codebase diagnostics, code reviews, sprint passes, and engineering sessions are 100% prepaid upfront through our verified Stripe checkout to protect studio calendar allocations. Because engineering time and static codebase inspections are committed upon booking, consultation fees are non-refundable once an audit or consultation has commenced.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles. Any dispute arising out of or related to these terms shall be resolved exclusively within the state or federal courts located in the City of New York.
